INJUSTICE: Innocents arrested and jailed, hate preachers remain free due to policemen's power to apply harsh laws selectively

In India, world’s biggest democracy, a huge debate is going on over incarceration of people who committed no crime and were framed.

A journalist who was going to cover a crime, was booked, arrested and languishes in jail. 

A doctor who saved lives of ailing children, was jailed for a speech and was much later given a ‘clean-chit’ by court, however, he had spent months in jail by then. A comedian was arrested even before 'cracking a joke'.

These are just three names from different fields. Apart from them, numerous activists are in prisons just because they were booked under harsh laws — one of them is Unlawful Activities Prevention Act or UAPA. It’s really strange, almost unbelievable that this can happen. 

That a man who came armed with pistol in front of university students, gets bail, another who makes inflammatory and threatening speeches day after day in Western UP is never arrested, yet another man who organised maha-panchayats and issued threats to minority community, was not detained.

In so many cases, such people were not even booked. It’s because the first step is an authority taking action and police doesn’t take ‘cognisance’. Or, even there is a person who is not high up in the rank and can be termed ‘fringe’ and arrested, then he gets booked under such sections that are ‘bail-able’.

Those who led a rally where slogans against Muslims were openly raised in Delhi recently and pamphlets containing extremely offensive content were distributed, [even minors brought in that demonstration], had it easy.

Such people, even when they are booked, are charged under such provisions that they get bail, within 24 hrs. This is because no UAPA  applied. No sedition charges either. The harsh National Security Act or NSA was not invoked and the officials prepared a soft case.

So it in a way creates a system where one person without committing an offence may rot in prison while other who is involved in issuing open threats, making genocidal comments, spreading hate, can breathe easy because no one is going to book them under a harsh law.

And, this is just a part of the story. People who have given inflammatory speeches in different states and that caused mob violence or communal riots, were saved because even after a case is registered, the State has power to withdraw charges.

Who will be booked or not booked under the harsh law, is a decision made by police officials. Laws can be applied selectively by an official who knows that depending on a person’s leaning or background or other factors, he will take ‘cognizance’ of his actions and act accordingly — case under a bail-able law or harsh law.

Even the video of a speech gets cleverly edited and a false complaint made, on the basis of which a person can be booked under harsh law, and will remain in detention and he, his family will suffer for months, year or even more, before it’s known that he committed no crime.

Worse, a standup comedian was arrested on the basis of a complaint. He hadn’t even performed in the city till then. But, a senior officer who arrested him, was quoted as saying that he hadn’t performed but he may have cracked a joke later’.

The names of a doctor, a comedian and a journalist mentioned to give an idea about the situation. The difference is clear when you see treatment meted out to Sharjeel Imam, Umar Khalid, Shahrukh on one hand or Rambhakt Gopal, Kapil Gurjar, Suraj Pal Amu and many more on the other hand.

Imagine, the seriousness of the situation. How do you resolve it when there is such disproportionate power — the power of ‘taking cognisance’, the power to book anyone and destroy their life, while let a hate-preacher get away without even detention!

Cops can add a section or just not add it. This causes sufferings for the person and his family. It’s an example of ‘show me the man, I'll show you the rule’. The officials know well depending on regime and political climate, how to act — very soft on one group, extremely tough on other. 

So that’s injustice at the first and critical stage. It can’t change until people realise how it impacts everybody. When there is public opinion. When top courts finally take a call on this power of police and administration.

Besides, does media even inform citizens about the double standards in implementation of law and actions, taking place! No. There are such twists, just listen how the TV anchors speak, that it confuses the ordinary viewer.

What would you do when one of the largest circulated dailies or the most viewed TV channels repeat a false claim and present in a way that it gives a totally wrong impression — that something happened though it didn’t happen at all!

But, as a result locally officials get under pressure or due to this reason, take unfair action. It can’t change until there is huge awareness and also action against those officials whose actions lead to false cases, undue harassment, unjust incarceration and such extreme injustice.

The freedom to consider an incident ‘cognizable’ or ‘non-cognizable offence’ just because of political line, affiliations or community link, and then adding harsh sections is nothing but a symbol of unfair action, tyranny, prejudice and clear double standards.

Recently, a movie and TV star’s video clip went viral. He was speaking in front of right-wing leaders and rued, “The issue is that people belonging to minority, are able to speak to us, look at us in our eye, talk as equals”.

If you want to subdue or harass minority or turn them second class citizens, will you bring a harsh law like UAPA, amend it to make it more tough, and then misuse it, so that discrimination becomes legal — through a law!

Idea of Justice, Equality and Opportunity: Seven illustrations that help children understand the world, power structure and society

How to teach the 'idea of justice', to children.  How to make them understand realities of the world.

And, make them learn the ills of 'system'--things like exploitation, oppression, need for diversity and equal opportunity, at a young age.

This is what I learnt from these comics in my childhood. These writers were brilliant, they taught you all--equality, compassion, need for justice, without using tough terms in these comics.

Just see these six-seven panels that I have selected from an old comic. In the story, that is pure fiction and entertainment, ideas of justice and equality were incorporated, and this goes on to the level that it inspires the reader.

If you read properly, you will understand the story. The change that came up after freedom--everyone is an equal. There is liberty, talent has the opportunity to come forward, people share knowledge, are inclusive, want to give equal opportunities to all irrespective of their past, financial or social status.

As power structure changes, the 'Old Order' and its proponents are unhappy.

They talk about 'taxes', irked over funding of public education and health, that why 'poor and non-elite' get treated as equals.

They're still powerful but feel 'insecure'. It happens in all societies.

There is a rise in insecurity when the poor or a new class emerges. We see it around us, even in our times. This phenomenon is always there, a group that resents any change and prefers 'traditional system'.

The 'Old Order' strikes back, wants a return to the past. 'Why should ordinary, common folk need education.

See the lines, 'Our power had gone, our land gone....we elite lose and our land is being distributed to poor'.

"If you get access to education, who will work for us, who will work on our fields".

It wants to bring 'old order' again, the 'Golden era', the 'imagined past'. And, here comes they who want their share in the loot. They are 'allies' now because they sense the opportunity to once again wrest control over resources, lord over poor.

Time for the loot!


There is resistance. The 'Old Order' fails to capture power.

Those who joined hands with the inclusive, just state, are pardoned.

'They wanted to stop wheel of change'. Now that's small part.

All these 6-7 panels would together form barely ONE page of the 30 page comic but more powerful than text books. No jargons like communism, socialism or talk of inclusive steps, diversity and equal opportunities, but this is understood.

This is a Flash Gordon comic. It was published in the eighties.

Though it was originally written in USA, they were published in India by a special arrangement with Indrajal Comics.

The artwork was improved, the comics here were better as quality was enhanced, comics were colorized.

This is just an example how certain writers tried to imbibe humane values. Personally, I am always fascinated by these writers.

They belonged to certain societies that may have been capitalist but the stories had such characters that egged on the reader to take STAND, always.

Stand against injustice, Stand against Oppression. And, stand against capitalist loot too. Quite interesting. Isn't it!

Flash Gordon was originally drawn by Alex Raymond. Flash and his companion Dale Arden, along with scientist Dr Hans Zarkov fight the evil Ming, in Mongo. Prince Barin leads the revolution and the power is snatched from the elite, it is now in the hands of the common people.

Turning a citizen into 'terrorist' without trial: Role of Dainik Bhaskar, section of Hindi media in turning 'aaropi' into 'aatanki'



Role of a section of Hindi media in turning 'aaropi' [suspect or accused] into 'criminal' or 'terrorist' even before completion of trial and judgment, is something that has affected a large number of under-trials.

If someone is guilty of crime or terrorism, stern action is definitely needed. 

The person must be booked under harsh laws and all evidences should be gathered to get him convicted.

But, if you term someone 'aatanki' or 'apradhi' i.e. 'terrorist' or 'criminal', even before the trial has been completed--it makes a mockery of justice and the entire system.

Sadly, this has been happening in India for years now. In North India and Central India, the situation is even more acute. Certain newspapers [more than TV channels] are involved in this dirty practice.

Violating Law of the Land

In central India, Dainik Bhaskar leads this trend. The law of the land says that a person is innocent till held guilty by the courts.

However, Dainik Bhaskar seems to have a right to call anyone terrorist even before trial is over. So police says, 'accused' but the paper terms it 'terrorist', which affects investigation.

Double standards

Aseemanand or Sandeep Dange may be accused in cases of bomb blasts but are not termed 'aatanki'. But the same newspaper terms even those Muslim youths 'aatanki, who face no blast or terror charge.

Just if there is accusation of association with a banned outfit, the Muslim youth is promptly termed 'aatanki'.  This is not the word police use after arrest. But newspaper creates scare and brands arrestd person.

Who is 'terror accused'?

Anyone who is involved in unlawful activities and association with banned outfits is booked under Unlawful Activities Prevention Act (UAPA).

It is registered against suspected Maoists, suspected ULFA cadre and those with suspected SIMI [Islamist] links, right-wing [Hindutva] groups. There are dozens of organisations banned in India.

Apart from them, members of outfits that are not banned are booked under the law. Many of them are not members of any outlawed groups but are caught for explosion, blasts or other terror-related acts.

None of them is termed 'aatanki'. However, among most newspapers, Dainik Bhaskar seems to have the 'power', an extra-constitutional power to name anyone 'terrorist' as per its discretion.

Irresponsible reporting affects, destroys families

When someone is judged a criminal or terrorist, it leads to entire society turning away from the person's family. It affects court cases and also entire life.

Families are destroyed because of irresponsible reporting. It is unfortunate that there has not been a serious action against newspapers that act as courts and assume the role of judges.

Gujarat massacre mastermind Babu Bajrangi gets bail 14th time: Where is the anger, media coverage, outrage?

Once again, Babu Bajrangi, has managed to get the bail.

Not first or second, it is 14th time that the convicted criminal has secured bail from the court.

Where is the outrage? 

Now, who is Babu Bajrangi. Not an ordinary criminal but someone who has been sentenced to life for committing one of the most grisly massacres in India.

As many as 97 persons were killed in the massacre in Ahmedabad during the Gujarat 2002 pogrom.

The man who had admitted on camera that he had raped, killed and set afire Muslim men and women.  Bajrangi was convicted in the Naroda Patiya killings and was sentenced to life imprisonment.

But, both Maya Kodnani and Bajrangi have been getting bails and are able to come out of jail on parole.

Sanjay Dutt, despite facing trial in TADA case, managed to get released on bail and parole too.
Similarly, terror accused--Asimanand and other co-accused also managed to get bail. Of course, there was no hue and cry.


When was the outrage seen? It was in the case of Shahabuddin, as if the unthinkable had happened and heavens had fallen. Clearly, law is not blind or emotionless. The names matter. The faces  matter.

If a face is close to a ruling party, then a crime of any magnitude would be pardoned. Isn't it?
